EXECUTIVE ORDER NO. 471
EXECUTIVE ORDER NO. 471 - AMENDING
EXECUTIVE ORDER NO. 319, SERIES OF 1987, ENTITLED “PROVIDING FOR THE
REORGANIZATION OF THE LOCAL DEVELOPMENT COUNCILS”
WHEREAS,
local development councils have been reorganized in the barangay,
municipal, city and provincial levels, pursuant to Executive Order No.
319, series of 1987;
WHEREAS, there is a need to provide a meaningful balance between
democratic representation which favors a larger number of
representation, and organization efficiency which favors a smaller
number of representation;
WHEREAS, there is a need to further strengthen the local development
councils to make them more efficient in accelerating economic and
social growth and development at the local levels;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by
virtue of the powers vested in me by law, do hereby order:
Section 1. Section 1 of Executive Order No. 319,
series of 1987, is hereby amended to read as follows:
“Section 1. Reorganization and Strengthening of the Local
Development Council. — The Provincial Development Councils, City
Development Councils, Municipal Development Councils and Barangay
Development Councils are hereby further reorganized and strengthened.
The Councils shall assist local legislative bodies in setting the
direction of economic and social development and coordinating
development efforts in their respective territorial jurisdictions.
1.1
Composition of Local Development Councils.
1.1.1
Barangay Development Council. The Barangay Development Council shall be
headed by the Barangay Captain and shall be composed of the following
members:
(i)
The members of the Sangguniang Barangay;
(ii) The
Department of Interior and Local Government (DILG) Operations Officer
assigned to the barangay, or if there is none, the DILG Operations
Officer assigned to the municipality/city;
(iii)
Representatives of government agencies working or assigned in the
barangay; and
(iv)
Representatives of the private sector and non-governmental
organizations (NGOs) operating in the barangay, who shall not be more
than one-forth (¼) of the members of the fully constituted
Council and who shall be confirmed by the ex-officio members of the
Council in accordance with the rules and regulations that may be
prescribed under Section 10 of this Executive Order.
1.1.2.
City Development Council and Municipal Development Council. The
City/Municipal Development Council shall be headed by the Mayor and
shall be composed of the following members:
(i)
The Barangay Captain;
(ii) The
Chairman of the Appropriations Committee of the Sangguniang
Panlungsod/Bayan;
(iii) Heads of
offices in the city or municipality of departments and agencies
represented in the Cabinet: Provided, That each Department or Agency
shall be represented by only one head of office;
(iv)
Representatives of the private sector and NGOs who shall not be more
than one-forth (¼) of the members of the fully constituted
Council and who shall be confirmed by the ex-officio members of the
City/Municipal Development Council in accordance with the rules and
regulations that may be prescribed under Section 10 of this Executive
Order;
1.1.3.
Provincial Development Council. The Provincial Development Council
shall be headed by the Governor and shall be composed of the following
members:
(i)
Mayors of Component Cities and Municipalities;
(ii) The
Chairman of the Appropriations Committee of the Sangguniang
Panlalawigan;
(iii) The
President of the Provincial Association of Barangay Council (ABC);
(iv) Heads of
offices in the province of departments and agencies represented in the
Cabinet: Provided, That each Department or Agency shall be represented
by only one head of office;
(v)
Representatives of the private sector and NGOs who shall not be more
than one-fourth (¼) of the members of the fully constituted
Council and who shall be confirmed by the ex-officio members of the
Provincial Development Council in accordance with the rules and
regulations that may be prescribed under Section 10 of this Executive
Order.
Sec. 2. Sec. 5 of Executive Order No. 319,
series of 1987, is hereby amended to read as follows:
“Sec.
5. Functions of the Local Development Council. — The
Provincial Development Council, City Development Council, and Municipal
Development Council shall have the following functions:
(i)
Formulate long-term, and medium-term, and annual socio-economic
development policies and plans as well as the corresponding
budget;
(ii) Formulate
medium-term and annual public investment programs;
(iii) Appraise
and prioritize the socio-economic development programs and projects;
(iv)
Coordinate local investment incentives to promote the inflow and
direction of private investment capital;
(v)
Coordinate, monitor and evaluate programs and projects; and
(vi) Perform
such other functions as may be provided for by law or competent
authority.
The
Barangay Development Council shall have the following functions:
(i)
Mobilize citizen’s participation in local government efforts;
(ii) Prepare
barangay development plan based on local requirements;
(iii) Monitor
and evaluate program and project implementation; and
(iv) Perform
such other functions as may be provided for by law or competent
authority.”
Sec. 3. Meetings of the
Provincial/City/Municipal/Barangay Councils. — The concerned Local
Development Council shall hold regular meetings once every six months,
on a day and time that may be agreed upon by the Council during its
initial meeting. However, it may call special meetings as the need
arises.
Authorized representatives of Congressmen may be allowed to participate
in their respective Local Development Council meetings on a non-voting
status.
Sec. 4. Sec. 2 of Executive Order No. 319,
series of 1987, is hereby amended to read as follows:
“Sec.
2. Executive Committee. The local development
councils, by council resolution, shall create an Executive Committee. —
2.1.
Composition.
2.1.1.
The Executive Committee of the Provincial Development Council shall be
chaired by the Provincial Governor and shall be composed of the
following members:
(i)
A representative of the Mayors of component cities within the Province
to be chosen by and from among themselves;
(ii) The
Chairman of the Appropriations Committee of the Sangguniang
Panlalawigan;
(iii) The
President of the provincial Association of Barangay Council (ABC);
(iv) The
President of the provincial chapter of the Municipal Mayors
League;
(v) One (1)
representative of the national agencies, to be chosen from and by the
Council;
(vi) One (1)
representative from the private/NGO sector to be chosen by the private
and NGO sector members of the Council themselves; and
(vii) The DILG
Provincial Operations Officer as ex-officio member.
2.1.2.
The Executive Committee of the City/Municipal Development Council shall
be chaired by the City/Municipal Mayor and shall be composed of the
following members:
(i)
The Chairman of the Appropriations Committee of the Sangguniang
Panlungsod/Bayan;
(ii) The
President of the City/Municipal City Association of Barangay Council;
(iii) One (1)
representative of the National Agencies to be chosen from among and by
the Council;
(iv) One (1)
representative from the private/NGO sector to be chosen by the
private/NGO sector members of the Council themselves; and
(v) The DILG
City/Municipal Operations Officer as ex-officio member.
2.1.3.
Participation of Other Council Members. The above composition
notwithstanding the Executive Committee may call any Council member to
be present and participate in any of its meetings, if and whenever
necessary.
2.1.4. The
Executive Committee shall be assisted by an Executive Secretary who
shall be the concerned Municipal, City or Provincial Planning and
Development Coordinator.
Sec. 5. Powers, Functions and Responsibilities of
the Executive Committee. —
5.1.
The Executive Committee shall have the following powers, functions and
responsibilities:
(i)
Ensure that the decisions of the Council are faithfully and effectively
carried out;
(ii) Act on
matters that need the immediate attention and/or action of the Council;
(iii)
Formulate policies in accordance with the general principles laid down
by the Council; and
(iv) Act on
other matters which the Council, by resolution, may so authorize.
5.2.
Matters Needing Confirmation by the Council
The Council, in its resolution
creating the Executive Committee, shall clearly identify those matters
on which the Executive Committee may take final action and those
matters which will need the Council’s confirmation.
Sec. 6. Meetings of the Executive Committee. — The
Executive Committee shall hold regular meetings at least once every
quarter on a day or days that may be agreed upon during its initial
meeting.
Sec. 7. Sec. 3 of Executive Order No. 319,
series of 1987, is hereby amended to read as follows:
“Sec.
3. Sectoral or Functional Committees. — The local
development councils may organize sectoral or functional committees in
accordance with the rules and regulations that may be prescribed under
Section 10 of this Executive Order.”
Sec. 8. Sec. 6 of Executive Order No. 319,
series of 1987, is hereby amended to read as follows:
“Sec.
6. Relation to Local Legislative Bodies and the
Regional Development Council. —
6.1
Sangguniang Barangay
The Sangguniang Barangay shall
approve the barangay development plan and its corresponding budget
proposed by the Barangay Development Council, prior to submission to
the City or Municipal Development Council for integration into the
Municipal or City Development Plan.
6.2
Sangguniang Panlungsod and Sangguniang Bayan
The Sangguniang Panlungsod and
the Sangguniang Bayan shall approve the city/municipal development plan
and its corresponding budget proposed by the component City or
Municipal Development Councils, prior to submission to the Provincial
Development Council for integration into the Provincial Development
plan.
6.3
Sangguniang Panlungsod of Highly Urbanized Cities
The Sangguniang Panlungsod of
Highly Urbanized Cities shall approve the city development plan and its
corresponding budget proposed by the City Development Council, prior to
submission to the Regional Development Council for integration into the
Regional Development Plan.
6.4.
Sangguniang Panlalawigan
The Sangguniang Panlalawigan
shall approve the provincial development plan and its corresponding
budget proposed by the Provincial Development Council, prior to
submission to the Regional Development Council for integration into the
Regional Development Plan.
6.5 Regional
Development Council
The Regional Development Council
shall integrate into the Regional Development Plan the provincial and
highly urbanized city development plans and their corresponding budgets
approved by the Sangguniang Panlalawigan/Panlungsod of highly urbanized
cities, prior to submission to the National Economic and Development
Authority (NEDA) Board, in accordance with Executive Order No. 308,
series of 1987.”
Sec. 9. Sec. 7 of Executive Order No. 319,
series of 1987, is hereby amended to read as follows:
“Sec.
7. Budget Information. — The Department of Budget and
Management and other national agencies shall furnish the councils
information on financial resources applicable to their respective
jurisdictions to guide them in their planning functions.”
Sec. 10. Sec. 9 of Executive Order No. 319,
series of 1987, is hereby amended to read as follows:
“Sec.
9. Implementing Authority. — The Department of
Interior and Local Government, in consultation with the Presidents of
the Leagues of Provincial Governors, City Mayors, and Municipal Mayors
and the Pambansang Katipunan ng mga Barangay (PKB), shall promulgate
the necessary guidelines to implement this Executive Order, subject to
the approval of the NEDA Board.”
Sec. 11. Repealing Clause. — All orders, rules and
regulations and other issuances or parts thereof, which are
inconsistent with this Executive Order, are hereby repealed or modified
accordingly.
Sec. 12. Effectivity. — This Executive Order shall
take effect fifteen days after publication in the Official Gazette or
in a newspaper of general circulation.
