Quoted hereunder, for your information, is a resolution of this court dated AUG 30, 1999.
G.R. No. 125912 (People of the Philippines vs. Maxima Cristobal y Asuncion a.k.a Do�a Mameng.)
Accused-appellant Maxima, together with two other persons were charged with violation of the Dangerous Drugs Law, as amended, for the unlawful transportation of 996.80 grams of metamphetamine hydrochloride or shabu. After trial, the lower court convicted appellant, sentenced her to reclusion perpetua and ordered her to pay a fine of P500,000.00. Her co-accused were both acquitted. After the case was elevated to this Court, appellant sought the withdrawal of her appeal in order to avail of executive clemency. The Correctional Institution for Women where appellant was confined attested to appellant's voluntariness to withdraw her appeal to which the Solicitor has no objection. In another letter addressed to the chief Justice, appellant reiterated her desire to withdraw appeal.
ACCORDINGLY, the Court GRANTS appellant's motion to withdraw appeal.
Let the records of this case be remanded to the Court of origin for execution of judgment.
