Quoted hereunder, for your information, is a resolution of this Court dated FEB 8, 1999.

G.R. No. 136111 (Heirs of Erlinda A. Reyes, represented by Georgina Reyes-Encanto vs. Alex L. Ong-David.)

Acting on the petition for review on certiorari, the Court RESOLVES to DENY the same as petitioners failed to take the appeal within the reglementary period fixed in Section 2, Rule 45 in relation to Section 5 (a), Rule 56 of the 1997 Rules of Civil Procedure in view of the denial of their motion for extension of time to file the petition in the resolution of December 14, 1998, and submit a written explanation why the service of copies of the petition on respondent was not does personally in accordance with Section 11, Rule 13 in relation to Section 3, Rule 45 and Section 5 (d), Rule 56 of the aforesaid Rules.
