Quoted hereunder, for your information, is a resolution of this Court dated FEB 22, 1999.
G.R. No.137027 (Vivian G. Woods vs. Hon Agnes Reyes Carpio, Branch 17, regional Trial Court of Manila.)
Acting on the petition for certiorari, the Court RESOLVES to DISMISS the same for failure to submit a certification, duly executed by petitioner herself, that no other action or proceeding involving the same issues raised in this case has been filed or is pending before this Court, the Court of Appeals or any other tribunal or agency, with the undertaking to inform the Court of any similar case filed or pending in nay court or quasi-judicial agency that may thereafter come to her knowledge in accordance with Section 3, Rule 65, Section 5, Rule 7 in relation to Section 3, Rule 46 and Section 2, Rule 56 of the 1997 Rules of Civil Procedure as amended, and for being premature, as petitioner failed to file the requisite motion for reconsideration of the assailed order with the respondent court prior to availment of this special civil action for certiorari and there are no sufficient allegations in the petition to bring the case within the recognized exceptions to this rule.
