Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 24, 1999.
G.R. No. 137195 (Joelson Oliva, et al. vs. National Labor Relations Commission, et al.)
In accordance with Rule 65 in relation to Rules 46 and 56, and other pertinent provisions of the 1997 Rules of Civil Procedure as amended governing petitions for certiorari, prohibition and mandamus filed with the Supreme Court, only petitions which comply with the requisites specified therein shall be entertained. On the basis thereof, the Court RESOLVES to DISMISS the petition for certiorari for failure of petitioner to:
(a) pay the amount of P500.00 as deposit for costs in violation of Section 3, Rule 46 in relation to Section 2, Rule 56;
(b) submit a written explanation for the non-personal service of copies of the petition on private respondents in accordance with Section 11, Rule 13, in relation to Section 2, (c), Rule 56; and
(c) state the date of filing of the motion for reconsideration of the assailed decision of the National Labor Relations Commission pursuant to Section 4, Rule 65 in relation to Section 3, Rule 46, as amended by Resolution dated July 21, 1998 of the Court En Banc in Bar Matter No. 803, in relation to Section 2, Rule 56.
