Quoted hereunder, for your information, is a resolution of this Court dated FEB 8, 1999.

G.R. No. 84857 (People of the Philippines vs. Rodolfo dela Rosa, et al., Rodolfo dela Rosa, Appellant.)

On January 16, 1998, a decision was rendered by this Court in G.R. No. 84857 ACQUITING Rodolfo dela Rosa of the crime of illegal possession of firearms and explosives. The Notice of Judgment and Order of Release were sent to the Bureau of Corrections, Administrative Division, which received them on January 19, 1988. (Rollo, p. 271). On February 26, 1988, a handwritten letter from Rodolfo Quimson, one of the co-accused of Rodolfo dela Rosa who did not appeal, was received by this Court. In his letter, Quimson asked whether the judgment of acquittal of Rodolfo dela Rosa is applicable to him. On June 22, 1988, we required the Office of the Solicitor General to comment. The Solicitor General recommended to extend the favorable judgment of acquittal to Quimson and one Antonio dela Rosa, also a co-accused who did not appeal. However, it appears from the record that Quimson escaped from the National Bilibid Prisons (NBP) when detained therein after being convicted by the RTC of Lingayen, Pangasinan.

IN VIEW WHEREOF, we resolve to DIRECT the Bureau of Corrections to: (1) report on whether our decision in G.R. No. 84857 has been implemented as to Rodolfo dela Rosa and (2) furnish us with information as to the whereabouts of Antonio dela Rosa and Rodolfo Quimson within a non-extendible period of three (3) days from receipt of this resolution
