ADRIANO GEPETULAN vs. ROBERTO HSIEH.
SECOND DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 22, 1999.
UDK-12675 (Adriano Gepetulan vs. Roberto Hsieh.)
The motion of petitioner for an extension of thirty (30) days from December 24, 1998 within which to file petition for review on certiorari is DENIED for failure to pay the deposit for costs and the prescribed legal fees, to serve a copy of the motion on the Court of Appeals, and to submit an affidavit of service of copies of the motion on respondents pursuant to Sections 2 and 3, Rule 45 in relation to Section 5(c), Rule 56 and to Sections 4 and 13, Rule 13 of the 1997 Rules of Civil Procedure as amended.
The urgent motion of Atty. Rufino B. Requina, Sr. to withdraw as counsel for petitioner with prayer that the new counsel be given a period of thirty (30) days within which to file the required pleadings is DENIED. It appearing that petitioner failed to file the intended petition for review on certiorari within the prescribed period, the Court RESOLVES (a) to INFORM the parties that no petition has been filed in this case and that the judgment sought to be reviewed has now become final and executory; and, (b) to declare this case CLOSED and TERMINATED.
Very truly yours,
TOMASITA M. DRIS
