Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated 06 FEB 2002.

G.R. No. 143366 (Luis Mario M. General vs. Ramon Roco);

G.R. No. 143524 (The Executive Secretary, et al. vs. Ramon Roco.)

This resolves the Motion for Reconsideration of the consolidated Decision of the Court dated January 29, 2001, which reversed and set aside the Decision of the Court of Appeals in CA-G.R. SP No. 55000 and dismissed the petition for quo warranto filed by respondent.

The Motion for Reconsideration failed to present any compelling reason to reverse the Decision of this Court. Therefore, the same should denied. However, this denial should be without prejudice to the supervening appointment of respondent by President Gloria Macapagal-Arroyo to the contested position of Regional Director, Land Transportation Office, Department of Transportation and Communications, vice petitioner Luis Mario M. General.

IN VIEW OF THE FOREGOING, the instant motion for reconsideration is DENIED with FINALITY. This denial is without prejudice to his recent appointment to the contested position.

The Court further Resolves to:

(a)������� NOTE the comment of respondent Ramon S. Roco on the manifestation and withdrawal of Atty. Efren Moncupa as counsel for petitioner in G.R. No. 143366 in compliance with the resolution of November 26, 2001; and

(b)������� GRANT the prayer of Atty. Moncupa to withdraw as counsel for petitioner in G.R. No. 143366.
