Gentlemen:
Quoted hereunder, for your information, is a resolution of this
Court dated

A.C. No. 6186 (Vicente
Follosco and Hermilina Follosco vs. Atty. Rafael Mateo.)
In the Decision dated February
3, 2004, the Court found respondent Atty. Rafael Mateo negligent in
notarizing several documents without the presence of the affiants thereby
causing damage to the rights of complainants Vicente Follosco and Hermilina
Follosco over the property subject of said documents. The Court ordered the
suspension of Atty. Mateo from the practice of law for three months and revoked
his incumbent notarial commission, with prohibition from being commissioned as
a notary public for one year. Atty. Mateo now moves for the reconsideration of
said decision and pleas for compassion. He states that: he is fifty-five years
old and is suffering from an immune deficiency; his treatment has exhausted his
resources and is presently seeking the aid of the Philippine Charity
Sweepstakes Office to subsidize his medical expenses; and his suspension from
the practice of law and revocation of his notarial commission will add burden
to his financial difficulties since this is his only source of income.
Acting on respondent's motion for reconsideration, the Court
Resolves to:
a)
CONSIDER
Atty. Mateo's period of suspension as
DEEMED
SERVED
in view of its immediate effectivity; and
b)
REDUCE
the period of prohibition against his commission as a
notary public to
SIX
MONTHS
for humanitarian reasons and equity.
