VILLANUEVA vs. RIDGE RESORT
FIRST DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this
Court dated
G.R. No. 164638 (Aurora Villanueva vs. Ridge Resort Convention Center, Inc.)
Before this Court is a Joint Motion to Approve Compromise Agreement filed by petitioner and respondent, assisted by their counsels, which reads, to wit:
"PARTIES, thru their respective counsels, and to this Honorable Court, respectfully submit for approval the following compromise agreement:
1)����� PARTIES recognize their respective capacity to sue and be sued as well as their earnest desire to settle amicably the instant case.
2)����� Accordingly, within thirty (30) days upon signing hereof, petitioner shall cause as she hereby causes the withdrawal of her appeal before this Honorable Court. Petitioner at the same time shall cause the removal of her concrete fence on the encroached or overlapped portion of Road Lot 1, Pcs-04-002323 by relocating the same by 2.15 meters outside of Road Lot 1, PCS-04-002323 and the property of respondent.
3)����� On the other hand, respondent shall waive and/or renounce all its claim or interest over the costs of suit incurred by the respondent in pursuing the instant case against petitioner.
4)����� PARTIES agree that the aggrieved party shall be entitled 10 a writ of execution against the party who shall not comply with this agreement, within thirty (30) days from execution thereof.
WHEREFORE, premises considered, it is respectfully prayed of this Honorable Court that the foregoing Compromise Agreement be APPROVED, it being not contrary to law, morals, customs, public policy or public order.
