(a) The 12-month progress review is a two step process: (1) Step one—Retrospective review. Did you complete the work requirements (as specified in §411.180 and §411.185) in the just completed 12-month progress review period? (i) If you have not completed the work requirements, the PM will find that you are not making timely progress toward self-supporting employment. (ii) If you have completed the work requirements, the PM will go to step two. (2) Step two—Anticipated work level. Do both you and your EN or State VR agency expect that you will work at the level required during the next 12-month progress review period? (i) If not, the PM will find that you are not making timely progress toward self-supporting employment. (ii) If so, the PM will find that you are making timely progress toward self-supporting employment. We will consider you to be making timely progress toward self-supporting employment until your next 12-month progress review. (b) If the PM finds that you are not making timely progress toward self-supporting employment, the PM will send a written notice of the decision to you at your last known address. The notice will explain the reasons for the decision and inform you of the right to ask us to review the decision. The decision will be effective 30 days after the date on which the PM sends the notice of the decision to you, unless you request that we review the decision under §411.205.
