(a) Approved program required. In order to receive a grant to administer and enforce a State program, the State must have an approved State regulatory program. (b) Designation of a State agency. In order to receive a grant to administer and enforce a State program, the Governor must designate a single agency to receive and administer administration and enforcement grants, including cooperative agreement grants described in §735.16 of this part. (c) Nondiscrimination. The agency shall monitor the compliance activity of its subrecipients with respect to the nondiscrimination provisions in §735.21(a)(4) of this part.
