(a) We, the regulatory authority, will rely upon the violation information supplied by you, the applicant, under §778.14 of this subchapter, a report from AVS, and any other available information to review histories of compliance with the Act or the applicable State regulatory program, and any other applicable air or water quality laws, for— (1) You; (2) Your operator; (3) Operations you own or control; and (4) Operations your operator owns or controls. (b) We must conduct the review required under paragraph (a) of this section before making a permit eligibility determination under §773.12 of this part. [65 FR 79663, Dec. 19, 2000]
