(a) A State is eligible for assistance under Part B of the Act for a fiscal year if the State demonstrates to the satisfaction of the Secretary that the State has in effect policies and procedures to ensure that it meets the conditions in §§300.121–300.156. (b) To meet the requirement of paragraph (a) of this section, the State must have on file with the Secretary— (1) The information specified in §§300.121–300.156 that the State uses to implement the requirements of this part; and (2) Copies of all applicable State statutes, regulations, and other State documents that show the basis of that information.
