Title 34 - Education
(a) Each public agency shall ensure that a full and individual evaluation is conducted for each child being considered for special education and related services under Part B of the Act— (1) To determine if the child is a “child with a disability” under §300.7; and (2) To determine the educational needs of the child. (b) In implementing the requirements of paragraph (a) of this section, the public agency shall ensure that— (1) The evaluation is conducted in accordance with the procedures described in §§300.530–300.535; and (2) The results of the evaluation are used by the child's IEP team in meeting the requirements of §§300.340–300.350.
