In determining the allocation under §§300.700–300.709 of a State in which the Secretary will implement a by-pass for private school children with disabilities under §§300.451–300.487, the Secretary includes in the State's child count— (a) For the first year of a by-pass, the actual or estimated number of private school children with disabilities (as defined in §§300.7(a) and 300.450) in the State, as of the preceding December 1; and (b) For succeeding years of a by-pass, the number of private school children with disabilities who received special education and related services under the by-pass in the preceding year.
