A person (including a railroad and any manager, supervisor, official, or other employee or agent of a railroad) who fails to comply with a railroad's operating rule issued pursuant to §218.39 of this part is subject to a penalty, as provided in appendix A of this part. [53 FR 52928, Dec. 29, 1988]
