PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. GERMAN AGOJO Y LUNA, ACCUSED-APPELLANT
Sirs/Mesdames:
Quoted hereunder, for your information, is a resolution of this Court dated 14 October 2009:
G.R. No. 181318 - PEOPLE OF THE PHILIPPINES, Plaintiff-Appellee, versus GERMAN AGOJO y LUNA, Accused-Appellant.
Considering the issues and arguments raised by the accused-appellant in his Motion for Reconsideration and Supplemental Motion for Reconsideration of the Decision of April 16, 2009 of the Court affirming his judgment of conviction for the sale of shabu pursuant to Republic Act (R.A.) No. 6425 or the Anti-Dangerous Drugs Act of 1972, as amended, the Court resolves to deny the motions for being mere reiterations of the issues and arguments earlier raised on appeal which we have passed upon in our Decision.
WHEREFORE, premises considered, the Motion for Reconsideration and Supplemental Motion for Reconsideration filed by accused-appellant German Agojo y Luna is hereby DENIED with FINALITY for failure to show any reason or justification to warrant a modification, alteration or reversal of our earlier ruling.
No further motion or pleadings shall be entertained. Let judgment be entered in due course.
SO ORDERED.
WITNESS the Honorable Leonardo A. Quisumbing, Chairperson, Honorable Conchita Carpio Morales, Minita Chico-Nazario (designated additional member per Raffle dated 19 August 2009 in lieu of Velasco, Jr., J., inhibited himself from further participating in this case), Arturo D. Brion and Diosdado M. Peralta, Members, Special Second Division, this 14th day of October, 2009.
