DOMINADOR P. ELEMENTO VS. PRESIDING JUDGE RICO A. TAN, MUNICIPAL TRIAL COURT IN CITIES, BR. 15, OZAMIS CITY
Sirs/Mesdames:
Please take notice that the Court, Second Division, issued a Resolution dated 13 December 2010 which reads as follows:
A.M. No. MTJ-10-1774 [Formerly A.M. OCA I.P.I No. 10-2259-MTJ] (Dominador P. Elemento vs. Presiding Judge Rico A. Tan, Municipal Trial Court in Cities, Br. 15, Ozamis City).� Before the Court is an administrative complaint against Presiding Judge Rico A. Tan of the Municipal Trial Court in Cities, Br. 15, Ozamis City.
The Court NOTES the Complaint-Affidavit dated April 9, 2010 filed by Dominador P. Elemento for violation of the New Code of Judicial Conduct relative to Crim. Case Nos. 8277-MTC and 8282-MTC for grave threats, and comment dated June 15, 2010 of respondent Judge Rico A. Tan.
The Court RESOLVES to ADOPT and APPROVE the findings of fact, conclusions of law and recommendation of the Office of the Court Administrator. Accordingly, the Court finds respondent Judge Rico A. Tan of the Municipal Trial Court in Cities, Br. 15, Ozamis City GUILTY of impropriety for violating Section 1, Canon 4 of the New Code of Judicial Conduct for which he is FINED Twelve Thousand Pesos (P12,000.00). Judge Tan is further sternly warned that a repetition of the same or similar acts in the future will be dealt with more severely.
