ARIEL LANTAJO Y CRISTOBAL AND GUILLERMO ALOJAMIENTO Y GUAPIN v. PEOPLE OF THE PHILIPPINES
G.R. No. 198558 (ARIEL LANTAJO y CRISTOBAL and GUILLERMO ALOJAMIENTO y GUAPIN v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments presented in the Petition for Review, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated March 24, 2011 and Resolution dated September 8, 2011 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated March 24, 2011 and Resolution dated September 8, 2011 of the Court of Appeals in CA-G.R. CR No. 32983 and AFFIRMS said Decision and Resolution finding petitioners Ariel Lantajo y Cristobal and Guillermo Alojamiento y Guapin guilty beyond reasonable doubt of Illegal Possession of 0.03 gram each of methamphetamine hydrochloride, also known as "shabu," in violation of Section 11, Article II of R.A. No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002, sentencing each of them to suffer the indeterminate penalty of imprisonment of twelve (12) years and one (1) day, as minimum, to fourteen (14) years, as maximum, and to pay the fine of P300,000.00 each.
