RE: REQUEST FOR THE CREATION OF ADDITIONAL DRUGS COURTS IN THE RTC, DUMAGUETE CITY
"A.M. No. 11-1-09-RTC (Re: Request for the Creation of Additional Drugs Courts in the RTC, Dumaguete City).- The Court Resolved, upon the recommendation of the Office of the Court Administrator, to
(a) NOTE the Letter dated August 5, 2011 of Hon. Rosendo B. Bandal, Jr., Presiding Judge, RTC, Branch 34, Dumaguete City, Negros Oriental;
(b) DESIGNATE RTC, Branch 36, Dumaguete City, Negros Oriental as a Drugs Court, vice RTC, Branch 34, Dumaguete City, Negros Oriental; and
(c) REVOKE the designation of RTC, Branch 34, Dumaguete City, Negros Oriental as additional Drugs Court.
The following guidelines shall be observed in the unloading of cases:
(a) RTC, Branches 34 and 36, Dumaguete City, Negros Oriental shall continue trying and deciding cases pending in their respective salas, where trial has already begun. For this purpose, trial has begun when the accused or any of the accused in a criminal case has been arraigned or when the pre-trial stage is terminated in civil cases;
(2) All drugs cases pending with the RTC, Branch 34, Dumaguete City, Negros Oriental, where trial has not yet begun, shall be forwarded to the Office of the Clerk of Court, for assignment by the Executive Judge to Branch 36, same station;
(3) All newly filed drugs cases shall be assigned to RTC, Branch 36, Dumaguete City, Negros Oriental until such time that the number of cases assigned to Branch 36, same station, is equal to the cases assigned to Branch 30; and
(4) The guidelines set forth in the resolution of the Court in A.M. No. 00-8-01-SC dated August 1, 2000 (Re: Designation of Certain Branches of the RTC as Drug Courts) shall be observed in so far as they are applicable."
