PEOPLE OF THE PHILIPPINES VS. RONALD RIVAS Y GARCIA
G.R. 175780 (People of the Philippines vs. Ronald Rivas y Garcia). - The records of this case were elevated to this Court on December 29, 2006, pursuant lo the Court of Appeals Resolution dated October 6, 2006 which gave due course to the notice of appeal filed by accused-appellant Ronald Rivas y Garcia.
In compliance with the Court's Resolution dated February 12, 2007, both the accused-appellant and the Office of the Solicitor General filed their respective manifestations and waiver stating that they were no longer filing their supplemental briefs with this Court; and they were adopting all the allegations, issues and arguments adduced in their respective briefs filed before the Court of Appeals.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the accused-appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law in the Decision dated August 31, 2006 of the Court of Appeals in CR-C.H. No. 01084, finding accused-appellant Ronald Rivas y Garcia guilty beyond reasonable doubt of rape defined and penalized under Article 266-A, paragraph l(a) in relation to Article 266-B, paragraph 1 of the Revised Penal Code, as amended, and to suffer the penalty of reclusion perpetua and to pay the private complainant the amount of Fifty Thousand Pesos (P50,000.00) as civil indemnity, Fifty Thousand Pesos (P50,000.00) as moral damages.
