PEOPLE OF THE PHILIPPINES V. RAMON ESGUERRA Y SANTOS
G.R. No. 194837 (People of the Philippines v. Ramon Esguerra y Santos). - The records of this case were elevated to this Court on January 11, 2011, pursuant to the Court of Appeals Resolution dated June 29, 2010 which gave due course to the notice of appeal filed by appellant Ramon Esguerra y Santos.
In compliance with the Court's Resolution dated January 26, 2011, both the Office of the Solicitor General and the appellant filed their Manifestations stating that they are no longer filing their Supplemental Briefs with this Court; and that they are adopting all the allegations, issues, and arguments adduced in their respective Briefs filed before the Court of Appeals.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the appellant to sufficiently show any reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated April 30, 2010 of the Court of Appeals in CA-G.R. CR-H.C. No. 03760, finding appellant Ramon Esguerra y Santos guilty beyond reasonable doubt of the crime of violation of Section 6(a), (1), and (m) of Republic Act No. 8042, otherwise known as the "Migrant Workers and Overseas Filipinos Act of 1995," for Large Scale illegal Recruitment, and sentencing him to suffer the penalty of life imprisonment and to pay a fine of Five Hundred Thousand Pesos (P500,000.00) and to return the amount of Five Hundred Thousand Pesos (P500,000.00) to complainant Edwin Ascano and the amount of Fifty Thousand Pesos each to complainants Homer Robles and Valentin Machado, and AFFIRMS said Decision in toto.
